disclaimer
ᚠ by commissioning me, you automatically agree in full with my terms of service & conditions.ᚢ if you have any questions, please send a DM to any of my socials, or email me at [email protected]ᚦ if you are not comfortable with my T.o.S and/or are not willing to agree to the conditions, you may not request a commission.
user agreement
ᚠ by commissioning me, you agree that you have read and accepted all the terms described herein.ᚢ to commission me, you must fully understand the limitations of VRoid Studio made VRM models.
general
ᚠ reference sheet including front + back view is required for model and outfit commissions, however exceptions can be made occasionally, (e.g. moodboard style references, lack of back view).ᚢ for all VRoid VRM commissions, I work exclusively within VRoid Studio unless otherwise agreed
upon.ᚦ The commissioner must respect that my artistic style cannot be altered.ᚨ In case of debut, please request for your commission to be private beforehand. Otherwise, I may choose to post WIP(s) of your commission on my relevant socials.ᚱ as the artist, I reserve the right to refuse any commission request that does not match my artstyle/vision. I may also refuse or cancel a commission due to inappropriate behavior, poor communication, emergencies, or breach of these Terms of Service.ᚷ I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.ᚹ clients who have commissioned and/or received work before this ToS has gone into effect are still bound to its contents.
revisions and feedback
ᚠ I will send work in progress images at notable stages, including but not limited to model base, outfit sketch, hairstyle, final renders.ᚢ These images will come in the form of .jpg or .png files as an attachment in the email or a DM.ᚦ Each time I send a WIP to a client, I ask the client to provide feedback to me for refinement and adjustment.ᚨ The responsibility is on you to ensure your order contains the details you want me to follow.ᚱ I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.ᚷ I will only send guaranteed WIP images at sketch and final render stages, but you are free to request a WIP or check in on progress at any given time, however I am not required to oblige.ᚹ Any large changes to the character design will be subject to a fee, and the fee will depend on the nature of the change.ᚺ I will not be held responsible for any changes in ownership of the said character.ᚾ After the order is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my faults (e.g., I overlooked details provided in the order).ᛁ In the absence of feedback from the customer, any changes to the final piece will be subject to a fee.ᛃ I will not completely redraw any completed model textures unless payment is received for a second order.
credit, copyright, & ownership
ᚠ as the artist, I reserve the right to sign and/or watermark my work when posted on my websites and social media.ᚢ credit to me, the artist, is required when you publicly use your model. For streaming and Vtubing use, this does not apply to various content made with your model (pictures, clips, etc.), however please credit & link back to me in your twitch or youtube description. (ylvie.uwu.ai)ᚦ you may not upload or host my work in any gallery that is intended to display your own work only.ᚨ you may not claim my work as your own.ᚱ you will have full commercial rights of the model/textures, with the exception of resale and redistribution.ᚷ alteration or editing to my textures is allowed, however resale/redistribution is prohibited regardless of modification.ᚹ please do not share any files created by me with third parties unless otherwise discussed beforehand.ᚺ you are responsible for protecting your ownership over rights to a character design.ᚾ In case of use for VRchat avatar, the model must be kept private.ᛁ I retain all copyright over my work, which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon.ᛃ I will however always respect and give proper credit to you and the artist for ownership of the model + character’s design.
commercial usage
ᚠ all model commissions are intended for commercial use, meaning any royalties are already included in the prices provided.ᚢ I only accept commercial usage model commissions unless otherwise agreed upon. However, the price stays the same regardless of private usage.
payment
ᚠ I will only accept payment in USD via Paypal. You are responsible for making currency conversions.ᚢ Payments via Paypal are sent via Invoice method only unless otherwise stated. I will cover the Paypal fees as it is expected from the Artist per PayPal ToS. What you see is what you will have to pay.ᚦ I am not responsible for any mistakes that are made on your part over the course of the transaction.ᚨ It is expected that you deposit 100% of the price upfront before I start. No exceptions unless otherwise discussed.ᚱ I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment.ᚷ if you happen to use a guardian PayPal account, please note that you hereby acknowledge that you have their permission to take part in this transaction.
paypal disclaimer
ᚠ please note that all of my commissions are considered “Digital Goods” and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.ᚢ Nothing is ever intended by either me or the Client, to be physically shipped to them.
refunds
ᚠ I can refund 100% of the payment only if I have not started working on the model.ᚢ Once I begin working on the commission, there will be no refunds.ᚦ If I cancel a project, I will reimburse the lost fees and refund 100%.ᚨ in case of payment plan, if you fail to provide the rest of your due total, i will not deliver the product and you will not be reimbursed.
chargebacks
ᚠ you are NOT authorized to issue a chargeback under any circumstance.ᚢ if for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.ᚦ you are required to contact me when you need to cancel a commission request.ᚨ purposefully issuing a chargeback without contacting me to cancel/refund a project will result in legal action.
work speed & deadlines
ᚠ you reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment and a fee might apply.ᚢ I have the right to decline a project if there is too short of a time allowance. The time I reserve to work on your model depends highly on the model complexity.ᚦ if you did not alert me to a deadline, you must not send reminders, but may check in with me at any point to talk about the progress.ᚨ I will work on commissions randomly. This means I will work on the piece I'm the most inspired/ comfortable with at the moment.ᚱ no harassment over my work speed will be tolerated, regardless of the time that has passed.ᚷ you reserve the right to be notified of any delays.
final product
ᚠ you, the client, are responsible for saving any information, .vroid + VRM Model file, and other digital data I provide.ᚢ I will send you the files via Google Drive Link or as an E-mail attachment zip file.ᚦ any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. however, I cannot guarantee against computer failure or accidental deletion or loss.

ᚠ Please note queue time is always an estimate that may be subject to change due to personal events, current commissions requiring more time, or expedited projects.ᚢ you may cancel or postpone your waiting list position at any time.ᚦ you will be notified of any change to schedule, such as delays or time becoming available.ᚨ once I am ready to take your commission, I will contact you via chosen platform. if I do not hear back from you within 7 days time, your slot will be passed along to the next in line.
